1. Acceptance of Terms
Welcome to Lush Charters Miami. By accessing our website, communicating with our team, or booking a yacht charter, you agree to strictly comply with and be bound by the following terms and conditions. If you do not agree with any part of these terms, please refrain from using our services.
2. Booking, Deposits, and Payments
- Deposits: A non-refundable deposit is required at the time of booking to secure your reservation on your requested date and vessel.
- Balance: The remaining balance must be paid in full prior to the departure date, precisely as specified in your booking agreement. Failure to pay the balance on time will result in cancellation without refund of the deposit.
- Security Deposit: Certain vessels may require a security deposit against damages, which will be fully refunded post-charter provided no damage has occurred.
3. Cancellations and Refunds
- Guest Cancellations: Cancellations made by the customer outside of the penalty period (usually 7-14 days prior, depending on the yacht) will receive a refund minus processing fees. Cancellations within the penalty period will result in forfeiture of the entire amount paid.
- Weather Cancellations: Lush Charters prioritizes your safety above all. If the Captain deems the weather unsafe for departure (e.g., small craft advisories, thunderstorms, high winds), you will be offered a reschedule to a new date or a full refund. Cloudy skies or light, passable rain are not considered unsafe weather and will proceed as scheduled.
4. Guest Conduct and Safety
- Captain's Authority: The Captain has absolute, final authority on board. All guests must follow crew instructions strictly regarding safety, vessel operation, and behavior.
- Zero Tolerance Policy: Illegal drugs of any kind, including marijuana (even for medical use), are strictly prohibited on board in accordance with strict US Coast Guard regulations. Non-compliance will result in the immediate termination of the charter and return to dock without any refund, and local authorities may be notified.
- Underage Drinking: Providing alcohol to minors or underage drinking is strictly prohibited on all vessels.
5. Damages and Liability
The charterer (the individual who secured the booking) assumes full financial responsibility for any damage to the vessel, its equipment, or any loss of items caused by themselves or their guests beyond normal wear and tear.
Lush Charters, the vessel owners, and the crew are not liable for personal injuries sustained on board or during water activities, nor for the loss, damage, or theft of personal belongings.
